Terms of Service

1. Acceptance of Terms

By creating an account or using the Buffrd platform — including the mobile app and website — you agree to be bound by these Terms of Service. If you do not agree, do not use Buffrd.

These Terms are a legally binding agreement between you and Buffrd.

2. Description of Service

Buffrd is a business management platform designed for mobile car wash and detailing operators. The Service includes tools for scheduling appointments, managing clients, processing payments, sending SMS communications, tracking routes, and managing business finances.

3. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and current.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@wagzly.com if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.

5. Subscription and Fees

• Access to certain features requires a paid subscription, available through in-app purchases on the Buffrd mobile app.
• All subscriptions are processed through the Apple App Store or Google Play Store. By subscribing, you agree to the applicable store's payment terms.
• Subscription pricing is displayed at the time of purchase and is subject to change.
• Refunds are handled in accordance with the refund policy of the App Store or Google Play Store through which you purchased.
• Failure to maintain an active subscription may result in loss of access to paid features.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Send spam, unsolicited messages, or communications that violate the Telephone Consumer Protection Act (TCPA) or similar laws.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service to transmit malware, viruses, or other harmful code.
• Misrepresent your identity or impersonate any person or entity.
• Interfere with or disrupt the integrity or performance of the Service.

7. SMS Communications

The Service enables you to send SMS messages (appointment reminders, booking confirmations, payment links, etc.) to your clients. You are solely responsible for ensuring compliance with all applicable laws governing SMS communications, including obtaining proper consent from your recipients. You agree to indemnify and hold us harmless from any claims arising from your SMS communications to your clients.

8. Payment Processing

Buffrd integrates with third-party payment processors to facilitate transactions. By using payment features, you agree to the applicable third-party processor's terms of service. We are not a party to transactions between you and your clients and are not responsible for payment disputes, chargebacks, or fraud.

9. Your Data

You retain ownership of all client data and business data you enter into the Service. By using the Service, you grant Buffrd a limited license to store, process, and display that data solely to provide the Service to you. We do not claim ownership of your data. 10. Intellectual Property

All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and design — are owned by Buffrd or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUFFRD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless Buffrd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any applicable law or third-party right, or (d) your SMS communications to your clients.

14. Termination

You may cancel your account at any time through the app settings or by contacting support. We may suspend or terminate your access to the Service at any time, with or without cause, with notice where practicable. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 11–13 and 15) will survive.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms with an updated effective date. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
